Yes.  I'm concerned about this as well.  When the conflict is between a
private party with a prior claim and a corporate interest, the WIPO is a
poor forum to ensure a equitable ruling, since WIPO is biased towards the
copyright holder.  But ICANN has an obligation to ensure that a private
voice with a ligitimate site (i.e. not a cybersquatter!), is protected, even
if the site disparages the copyright holder.

Agreed.  The first step in developing an action plan is defining the
problem!  :)
